Information for foreign citizens planning to study and for students studying in Russian educational (scientific) organizations at the moment.

In accordance with Article 6.2 of the Federal Law "On the Legal Status of Foreign Citizens in the Russian Federation" (hereinafter - the Federal Law) from January 1, 2023 foreign citizens who are full-time students at a state educational or state scientific organization getting Bachelor's degree, Master's degree, or studying under specialty, residency or internship programs having state accreditation, or under the program of training of scientific and scientific-pedagogical personnel in graduate school (adjunct) in a state educational or state scientific organization, are given the opportunity to apply for a temporary residence permit for the purpose of education (hereinafter –TRPE).

The TRPE is given for the period of mastering the training program and for the next one hundred and eighty calendar days after finishing the training period. Getting a positive decision on the issuance of the TRPE, a foreign citizen should have an appropriate stamp in his/her passport.

The documents for the issuance of the RVPO are submitted by a foreign citizen personally or through the Unified Portal of the State and Municipal Services to the migration department, on the territory where the training takes place.

TRPE provides foreign students and postgraduates with a number of advantages:

if a foreign citizen has arrived on a visa basis, he will be issued a multiple-entry visa for the duration of the TRPE;
there is no obligation to submit an annual notification of confirmation of residence in the Russian Federation, unlike other modes of residence in the Russian Federation;
a student (graduate student) who has received an TRPE will be able to stay in the Russian Federation for the entire period of study, and after completing the training period he is permitted to continue his staying in the RF for another six months, during which it is possible to apply for a residence permit without leaving the Russian Federation;
the opportunity to apply for a residence permit is also provided for another three years after completing training course without obtaining a temporary residence permit;
Confirmation of Russian language proficiency, knowledge of the history and the basics of the legislative system of the RF are not required.

In a case of transition to full-time, part-time education or early termination of training (before official date) in a state educational (scientific) organization, the TRPE is canceled.

After the cancellation of the TRPE, if there are serious reasons, a foreign citizen has the right to re-apply for the issuance of the TRPE without observing the deadline provided for in paragraph 6 (Article 6) in the Federal Law, He can apply not earlier than one year from the date of rejection of his previous application for the issuance of the TRPE or cancellation of the previously issued TRPE.

Информация для иностранных граждан, планирующих обучаться и обучающихся в российских образовательных (научных) организациях.

С 1 января 2023 года иностранным гражданам, проходящим обучение в государственной образовательной или государственной научной организации по очной форме по программам бакалавриата, специалитета, магистратуры, ординатуры, ассистентуры-стажировки, имеющим государственную аккредитацию, или по программе подготовки научных и научно-педагогических кадров в аспирантуре (адъюнктуре) в государственной образовательной или государственной научной организации., предоставлена возможность обратиться с заявлением о выдаче разрешения на временное проживание в целях получения образования (далее - РВПО) в соответствии со статьей 6.2 Федерального закона «О правовом положении иностранных граждан в Российской Федерации» (далее - Федеральный закон).

РВПО выдается на срок освоения программы обучения и последующие сто восемьдесят календарных дней после окончания срока обучения, при положительном решении о выдаче РВПО в паспорт иностранного гражданина проставляется соответствующий штамп.

Документы о выдаче РВПО подаются иностранным гражданином лично или через Единый портал государственных и муниципальных услуг в подразделение по вопросам миграции, на территории которого проходит обучение.

РВПО предоставляет иностранным студентам и аспирантам ряд преимуществ:

в случае, если иностранный гражданин прибыл в визовом порядке, ему будет выдана многократная виза на срок действия РВПО;
отсутствует обязанность подавать ежегодно уведомление о подтверждении проживания в Российской Федерации в отличие от других режимов проживания в Российской Федерации;
студент (аспирант), получивший РВПО, сможет находиться в Российской Федерации в течение всего срока обучения, а после завершения обучения еще полгода, в течение которых можно без выезда из Российской Федерации подать заявление о выдаче вида на жительство;
возможность подать заявление о выдаче вида на жительство также предоставля¬ется в течение трех лет после завершения обучения без получения разрешения на вре¬менное проживание;
подтверждение владения русским языком, знания истории и основ законода¬тельства Российской Федерации не требуется.

При переходе на обучение по очно-заочной или заочной форме или досрочном прекращении обучения в государственной образовательной (научной) организации РВПО аннулируется.

После аннулирования РВПО при наличии оснований иностранный гражданин вправе повторно обратиться с заявлением о выдаче РВПО без соблюдения срока, предусмотренного пунктом 6 статьи 6 Федерального закона (не ранее чем через один год со дня отклонения его предыдущего заявления о выдаче РВП либо аннулирования ранее выданного ему РВП).
